1. ACCEPTANCE OF TERMS
Welcome to Adedia's eStrata service. Your use of this service is subject to these Terms of Service ("TOS"). Adedia reserves the right to update and change the TOS occasionally without notice or acceptance by you. You can view the most current version of the TOS at any time by visiting this page. Please review these TOS regularly to keep abreast of any changes. By using the Service, you signify you irrevocable accept these TOS.
Because the Terms of Service contain legal obligations, please read them carefully. Failure to comply may result in account termination.
2. DESCRIPTION OF SERVICE
The Service Adedia offers is web-based Software as a Service. Adedia creates a website for each Registered User. Each Registered User can post content to his or her website. Unless explicitly stated otherwise, any new features, including the release of new Adedia tools and services, shall be subject to the TOS. In order to use the service, you must obtain access to the World Wide Web and pay any service fees associated with such access. In addition, you must provide all equipment necessary to make such connection to the World Wide Web, including a computer and modem or other access device.
3. ACCESS
Adedia may provide Registered Users with password protected access to their website account. You agree to immediately notify Adedia in writing of any unauthorized use of your account or any other breach of security, and log off your account at the end of each session. Adedia cannot and will not be liable for any loss or damage arising from your failure to comply with this section.
In consideration of use of the Service, you agree to provide true, current, accurate, complete information about yourself. If you provide any information that is untrue, outdated, inaccurate or incomplete, or if Adedia has grounds to suspect that such information is untrue, outdated, inaccurate or incomplete, Adedia has the right to suspend or terminate your account. Users under 13 years of age are prohibited from using the Service.
4. CANCELLATION AND TERMINATION POLICIES
If you cancel the Service, your cancellation will take effect immediately. After cancellation, you will no longer have access to your Web site. Adedia may delete the information contained within your site. Adedia accepts no liability for such deleted information or content.
While your Service is active, Adedia may hold and manage your site's domain name. After cancellation, the domain name will be transferred to another service provider, at no additional expense to you, at your request.
If you fail to pay your Setup charge, Adedia will not launch your site. If you fail to pay for your monthly Service on the payment due date, Adedia will, at its discretion, take down your site within 30 days. After 6 months of non-payment, Adedia will cancel the Service, at which time, Adedia may delete the information contained within your site.
5. REFUND POLICY
Adedia offers its websites under a Software as a Service (SaaS) licensing agreement. Typically, Adedia does not provide refunds. If you cancel your site at least 5 days prior to the next billing date, Adedia will take down your site and will not charge you again.
If you have pre-paid for a 1-year service package, Adedia will refund you the unused monthly charges for all full months remaining on your plan. Please notify us in writing of your intention to cancel, and Adedia will provide a full refund of your payment, if applicable.
Adedia will not be held responsible, under any circumstances, for charges (including NSF charges) you incur as a result of erroneous charges against your credit card or as a result of you neglecting to cancel your service or automatic payments in a timely manner.
6. WEBSITE CONTENT
Adedia does not own the Content you place on your Adedia eStrata Website. By submitting content for inclusion on an Adedia website, you grant Adedia a royalty-free, international, non-exclusive license to reproduce and publish the content on your Adedia website. This license exists only for as long as you are an Adedia client.
Adedia provides unlimited storage of documents relating directly to the management and maintenance of your condo or strata. The upload of copyrighted materials (unless you hold the copyright) is prohibited. Storage of documents that do not pertain to your condo or strata is also prohibited. Failure to comply with this may result in termination of your account or in a limit being placed on the amount of document storage space granted to your condo or strata.
7. LINKS
Your website may provide links to other World Wide Web sites. Because Adedia has no control over such sites, you acknowledge and agree that Adedia is not responsible for the availability of such external sites and that Adedia does not endorse and is not responsible or liable for any content, advertising, products or other materials on or available from such sites. You further acknowledge and agree that Adedia shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with content, goods or services available on or through any third party sites.
